Course Overview
Mediation is an alternative, friendly method of dispute resolution, and is used to resolve commercial and other disputes in a peaceful, efficient, quick and cost-effective way. It is also recognised as the most successful of all dispute resolution methods, including litigation. Particularly with regard to the judicial route, which is time-consuming and often costly, mediation is in many cases a suitable substitute for the courts because of its obvious advantages.
This course is approved by the Ministry of Justice and Public Order and you can use this certification in order to fulfil the training requirement set by the ministry of justice in order to register as a mediator.
Seminar Content
The 40-hour training programme for mediators is designed in accordance with the provisions of Law 159(I)/2012 on Certain Issues of Mediation in Civil Disputes and its thematic modules include an introduction to alternative dispute resolution (ADR) methods, an introduction and then a full analysis of the institution of mediation as an alternative way of resolving private law disputes (civil and commercial) and a presentation of mediation in the European and international context with all the latest developments in the field.
Who Should Attend
The programme is addressed to those interested in out-of-court dispute resolution. Given the crisis and the structural problems of the regular justice system, new forms of dispute resolution, such as mediation, are the modern tools for resolving disputes (commercial, family, labour, civil, neighbour law, medical malpractice, etc.), as the European Union itself has pointed out. According to the relevant Directive (52/2008), out-of-court dispute settlement should soon be given a balanced relationship with ordinary justice, which shows that there is a clear trend towards institutions such as mediation.
